I went through the red light camera at the intersection of Pennant Hills Road and Parkes Street Thornleigh at 7:45 am this is our daily commute to drop my daughter to school (traveling north) The traffic is congested at this time of the morning on both the sides of the road and the right hand turn is always backed-up. The camera image shows that I have committed the turn and am amongst 5 other cars trying to make our way on to Parkes Street. The traffic on the other side of the road is at a sand still, to my knowledge I was past the white line and at a standstill on the intersection waiting for the rest of the cars ahead of me to make the turn even before the right hand arrow turned red. Is there are way to argue against this violation? thanks & regards d
I have had offenses (pakring, speeding >10 k in a 40k zone ) in the past but currently my record is clean with all points intact
This has been my strategy from the start I was hoping that I could argue the case by seeking leniency on the grounds that this is a daily occurrence of traffic jams at that intersection and you are caught at times in the no-mans's zone and as you can see from the images I may have just pipped myself to the camera.
Also is it possible that the other could have triggered the camera and as my car was in the crawl it was highlighted as the offending vehicle? or do all the cars get an infringement notice?
What do you mean by "You would set out the congestion"?
Also it does not make sense if I trigger the red light camera but choose to stay at the intersection whilst the other cars go thru potentially creating an accident - the image shows that it wasn't a case of reckless driving, it was just a case of congestion - does this make sense?
Has there been precedent where leniency has been show when one argues the case of congestion?
Yes this is clear - so best way is to first ask for leniency and if this fails then go for the court action.
