My name is XXXXX XXXXX X am a NSW Solicitor. Thank you for your question, and will do my best to assist you with your question.
There is no best way to do this.
You need to get advise from your accountant because this does not only work to protect assets it also has ramifications tax wise.
There is stamp duty to be paid if it is not done correctly and also Capital Gains if there are investment properties.
You would have a corporate trustee and a Trust set up that is managed by the trustee.
The more you remove yourself from the assets the better and if you have someone you can trust to be the director of the corporate trustee you would be even more secure.
The trust would be a discretionary trust and the trustee can distribute to any beneficiary as well as you at their discretion.
But your should get financial advise from an accountant before you start doing anything.
I hope this is of assistance. If I have missed anything, or if you have any further questions please let me know. If not I can arrange to have you rate my work.
You are very welcome and thank you for using my services.
