if I set tempature to max warm it will go back to 40 degrees
and if I set it at 38 it will get cooler to 33 or below

Okay , First you need to see if the damper is stuck in this. the damper is up in the left corner inside the refrigerator section, its number 8 on this diagram. take the cover off and see if its stuck wide open.

are your controls in the door (freezer) for controlling the temp?

okay perfect. that damper that you checked that opened is the issue. you can see the temp sensors (two white ) those are what tell the damper to open and close depending on how cold the refrigerator section is, if these don't sense the temp correctly they will open the damper and keep it open to long. you need to order and replace it. heres a link to order it. damper thanks and best wishes.
